Lawful bases and your data protection rights

Under UK data protection law, I must have a “lawful basis” for collecting and using your personal information. There is a list of possible lawful bases in the UK GDPR. You can find out more about lawful bases on the ICO’s website.

Which lawful basis I rely on may affect your data protection rights, which are set out in brief below. You can find out more about your rights and the exemptions which may apply on the ICO’s website.

• Your right of access. You have the right to ask me for copies of your personal information. You can request other information such as details about where I get personal information from and who I share it with. There are some exemptions, which means you may not receive all the information you ask for.
• Your right to rectification. You have the right to ask me to correct or delete personal information you think is inaccurate or incomplete.
• Your right to erasure. You have the right to ask me to delete your personal information.
• Your right to restriction of processing. You have the right to ask me to limit how I can use your personal information.
• Your right to object to processing. You have the right to object to the processing of your personal data.
• Your right to data portability. You have the right to ask that I transfer the personal information you gave me to another organisation, or to you.
• Your right to withdraw consent. When I use consent as my lawful basis, you have the right to withdraw your consent at any time.

If you make a request, I must respond without undue delay and in any event within one month. To make a data protection rights request, please contact me using the details at the top of this notice.

My lawful bases for collecting and using your data

My lawful bases for collecting or using personal information to provide and improve products and services for clients are:

• Contract. I have to collect or use the information so I can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object.
• Legitimate interests. I am collecting or using your information because it benefits you, my business or someone else, without causing an undue risk of harm to anyone.

I am a sole trader providing social media strategy, content creation and community management to brands. To deliver that service I hold basic contact details for the people I work with at each client: name, business email address, and the correspondence between us. I also hold access to the social media accounts I manage on their behalf, and the shared content calendars and files the work runs through.

This is necessary because there is no way to plan, produce, approve, schedule and publish a month of content, or to answer an enquiry, without being able to contact the person involved and keep a record of what was agreed. Using this information lets me deliver what a client has paid for, keep approvals and amendments properly documented so that neither of us is relying on memory, and understand what worked over the course of a contract so the next month is better than the last.

The benefit runs both ways. The client gets work delivered on time, a clear written record of decisions, and one person who knows their account properly. I get to run a business that keeps its commitments and improves at what it does.

The impact on the people involved is low. This is business contact information, given to me willingly so that we can work together, and used only for the purpose it was given for. I do not buy contact lists, I do not sell or share information for anyone else’s marketing, I do not use it for automated decision making or profiling, and I do not use client information to promote unrelated things. I keep only what the work requires, and anyone can ask me to see, correct or delete their details at any time. For those reasons my interest in holding this information does not override the rights and expectations of the people it belongs to.

Where I get personal information from

How long I keep information

• Enquiries that do not become work. Kept for up to twelve months so I can pick the conversation back up, then deleted.
• Client records. Contact details, agreements, approvals and invoices are kept for the length of our working relationship and then for six years after the end of the tax year in which the work finished, to meet HMRC record keeping requirements.
• Content and assets. Held in the shared drive for the length of the contract. The client keeps their copy. Mine is deleted within twelve months of the contract ending unless we agree otherwise.
• Account access. Removed as soon as our working relationship ends.
• Newsletter subscribers. Held until you unsubscribe, which you can do from any email I send.
